A letter from Obadiah B. McFadden to the Election Board at Tumwater, instructing the Board that it may accept votes from residents of 20 days provided they have been residents of the Territory for six months.

The brief, written by Elwood Evans, outlines the reasons why the defendant should be discharged. A verdict had been rendered by a jury and a warrant issued to hang the defendant, but Judge O. B. McFadden issued a supersedeas and the Supreme Court decided that there was no judgment and nothing to review. The brief is also available on microfilm.
